1. Acceptance of Terms

By accessing or using the Little Words application, website, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Little Words, Inc. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

If you are creating an account on behalf of a child, you represent that you are the child’s parent or legal guardian and that you consent to the child’s use of the Service subject to these Terms and our Privacy Policy.

2. Service Description

Little Words is an AI-powered speech practice companion designed for children with speech and language challenges, including articulation disorders, apraxia, phonological delays, autism-related communication needs, and general language delays.

The Service includes AI-guided speech sound practice, social communication activities, emotional expression modules, a parent dashboard with progress reports, and an adaptive curriculum that adjusts to each child’s skill level.

3. Age Requirements and Parental Consent

Little Words is designed for children ages 3 through 12. Because our users include children under 13, we comply fully with COPPA and all applicable child privacy regulations.

• Parental Consent Required - A parent or legal guardian must create the account and provide verified parental consent before any child under 13 can use the Service.
• Parental Controls - Parents retain full control over their child’s account, including the ability to review session data, modify settings, restrict usage, and delete the account at any time.
• Supervision Recommended - We recommend that parents supervise their child’s use, particularly for children under 6.
• Consent Withdrawal - Parents may withdraw consent and request deletion of their child’s information at any time via privacy@littlewords.ai or through the parent dashboard.

If you have concerns about your child’s speech or language development, consult a licensed speech-language pathologist. Do not delay seeking professional advice because of information provided through Little Words.

5. Subscription Terms

• Free Trial - New users get a 14-day free trial with full access. No credit card required. If you don’t subscribe before the trial ends, access will be suspended.
• Auto-Renewal - Subscriptions auto-renew monthly at $29.99 unless you cancel before the next billing date.
• Cancellation - Cancel anytime through account settings. You keep access until the end of your current billing period. No partial refunds.
• Price Changes - We will notify you at least 30 days in advance of any price changes via email.

6. User Responsibilities

• Accurate Information - Provide accurate information about your child when creating their profile. Inaccurate information may affect the quality of exercises.
• Supervision - Appropriately supervise your child’s use. While Little Words includes content filtering and safety features, parental oversight is important.
• Reporting Concerns - Promptly report any concerns about the Service, including inappropriate content or technical issues, to support@littlewords.ai.
• Account Security - You are responsible for maintaining the confidentiality of your account credentials.
• Acceptable Use - Do not misuse the Service, attempt to reverse-engineer the AI systems, or access the Service through automated means without written permission.

All content, features, and functionality of the Service are owned by Little Words, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use in connection with your child’s speech practice.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer or attempt to extract the source code.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LITTLE WORDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

IN NO EVENT SHALL LITTLE WORDS’ TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID DURING THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Little Words is not liable for any harm resulting from reliance on AI-generated content, failure to seek professional advice, or any outcomes related to your child’s speech development.

10. Termination

• By You - Cancel anytime through your account settings or by contacting support@littlewords.ai. You keep access until the end of your billing period.
• By Us - We may suspend or terminate access if you violate these Terms, engage in abusive activity, or pose a risk to other users.
• Effect - Upon termination, your right to access the Service ceases immediately. Sections that by nature should survive will continue to apply.

11. Changes to Terms

We may update these Terms to reflect changes in our practices or applicable laws. For material changes, we will provide at least 30 days notice via email. Continued use constitutes acceptance.

12. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the state or federal courts located in Wilmington, Delaware.
